Understanding the Mexican Fideicomiso
What is a Fideicomiso?
A Fideicomiso is a safe, legal bank trust structure authorized by the Mexican government. Under this trust, the Mexican bank acts as the trustee (holding the legal title), while you (the buyer) are designated as the primary beneficiary. You retain all rights of ownership, including building, selling, renting, or passing the property to heirs.
Why is it Required?
The Mexican Constitution originally restricted foreign nationals from owning land in the "Restricted Zone." The Foreign Investment Law of 1973 created the Fideicomiso to bypass this restriction safely, giving foreign buyers absolute legal protection and private ownership rights equivalent to direct deeds.
Ongoing Maintenance
Once set up, your only ongoing trust obligation is the annual maintenance fee, paid directly to the bank. Keeping this active ensures your ownership title remains fully registered and in good standing in the public registry.
